การวิเคราะห์ปัจจัยด้านกฎหมายที่เกี่ยวข้องกับความมั่นคงด้านยาในประเทศไทย: การทบทวนวรรณกรรมอย่างมีขอบเขต

เป้าหมายการพัฒนาที่ยั่งยืนของสหประชาชาติเกี่ยวกับสุขภาพและความเป็นอยู่ที่ดีมีความเชื่อมโยงกับความมั่นคงด้านยา ซึ่งในการศึกษานี้หมายถึง “การมียาจำเป็นใช้” สำหรับสถานการณ์ปกติและฉุกเฉิน การศึกษานี้เป็นงานวิจัยทุติยภูมิ ด้วยวิธีการทบทวนวรรณกรรมอย่างมีขอบเขต เพื่อรวบรวมข้อมูลปัจจัยทางด้านกฎหมายที่เกี่ยวกับความมั่นคงด้านยาในประเทศไทยตั้งแต่ 1 มกราคม พ.ศ. 2543 จนถึง 31 สิงหาคม พ.ศ. 2567 จากฐานข้อมูลวิชาการ และประเมินโดยใช้ PRISMA-Scr Flow diagram ร่วมกับการค้นหาความตระหนักในกฎหมายที่เกี่ยวข้องกับความมั่นคงด้านยาผ่านฐานข้อมูลข่าว Newscenter X เพื่อวิเคราะห์อุปสรรคด้านกฎหมายที่ส่งผลกระทบต่อความมั่นคงด้านยาในสถานการณ์ปกติและฉุกเฉิน และสืบค้นจากฐานข้อมูลกฎหมายเพื่อค้นหาว่ามีกฎหมายใดที่นำมาใช้จัดการปัญหาที่กระทบต่อความมั่นคงด้านยา การศึกษานี้พบว่า ปัญหาหลักที่ส่งผลต่อความมั่นคงด้านยาในประเทศไทยประกอบด้วยการพึ่งพาการนำเข้าวัตถุดิบทางยา การจัดการห่วงโซ่อุปทานยาที่ไม่มีประสิทธิภาพ ความซับซ้อนของกฎหมายที่เกี่ยวข้องกับสิทธิบัตร การแข่งขันทางการค้า และการค้าระหว่างประเทศ ได้ขัดขวางการผลิตและการเข้าถึงยาชื่อสามัญ นอกจากนี้ ระบบการจัดซื้อและจัดหายาในสถานการณ์ฉุกเฉิน ไม่สามารถตอบสนองต่อความต้องการได้ทันเวลา ระบบกฎหมายในประเทศต้องได้รับการปรับปรุงเพื่อให้เกิดความมั่นคงด้านยา ข้อเสนอแนะหลักในการศึกษานี้ คือ การพัฒนากรอบกฎหมายใหม่เพื่อสนับสนุนการผลิตยาในประเทศ การปรับปรุงระบบการจัดซื้อจัดจ้างให้มีประสิทธิภาพ มีความยืดหยุ่นและรวดเร็ว รวมถึงการใช้มาตรการบังคับใช้สิทธิตามสิทธิบัตรในกรณีจำเป็นเพื่อเพิ่มการเข้าถึงยาราคาเหมาะสมสำหรับประชาชน
