Abstract

           The objectives of this study were to 1) examine problems relating to individual’s rights to privacy and the protection of personal data which are fundamental to international data protection laws; 2) study legal principles relating to international transfer of personal data and the EU and US personal data transfer agreements in terms of impact to Thai laws; and 3) propose the amendments of Thai laws in relation to the Personal Data Protection Act to be in line with international laws. The key informants consist of 10 lawyers and academic experts.

           The research results reveal the following findings. 1) The transfer of personal data is critical to electronic transactions. However, there are several limitations concerning personal data protection laws. These limitations cause legal obstacles for transferring personal data between countries which have different legal principles such as the case of agreement between the European Union (EU) and the United States of America (the U.S) which also affects Thai laws in the digital age. 2) There are still several problematic issues, for example; the differences of Thai and EU laws in aspects of data controller obligations, and the integration of data protection principles at several stages. 3) EU law and EU courts require several conditions for transfer of data including legal context of the country receiving data which should not have broad laws empowering authorities to intercept personal data. This context is the crucial factor why the EU court considers the data transfer agreement between US and EU invalid as indicated in Case C-362/14
